Welcome to Dreamwalk Park!

Thank you for choosing to visit Dreamwalk Park (“the Park”). These Terms and Conditions (“Terms”) govern your access to and use of our services, facilities, and attractions. By purchasing a ticket and/or entering the Park, you agree to comply with these Terms. Please read them carefully.

1. Ticketing and Admission

• Ticket Validity: Tickets are valid only for the date and time specified. Tickets are non-transferable and non-refundable.
• Proof of Purchase: Visitors must present a valid ticket (electronic or printed) upon entry.
• Age Restrictions: Guests under 13 years of age must be accompanied by an adult.
• ID Verification: Dreamwalk Park reserves the right to verify identification for age-restricted areas or events.

2. Conduct and Safety

• Park Rules: Visitors must adhere to all posted signs, guidelines, and instructions provided by Dreamwalk Park staff. This includes respecting park areas, exhibits, attractions, and other guests.
• Prohibited Items: The following items are not allowed within the Park:
  • backpacks
  • bags larger than 12” x 12” x 6”
  • strollers
  • outside food and beverages (exceptions may apply for medical reasons)
  • weapons, hazardous materials, and illegal substances of any kind
  • alcoholic beverages, unless explicitly authorized
  • rolling or riding recreational devices (rolling medical devices including wheelchairs, mobility scooters, walkers, and knee walkers are allowed)
  • animals (other than ADA-compliant service animals)
  • disruptive items
  • masks not made for medical purposes (unless park-authorized for an event)
  • items which may cause damage or be difficult to clean
• Behavior: Disruptive, offensive, or violent behavior, including intoxication or harassment, is strictly prohibited. Dreamwalk Park reserves the right to remove any individual engaging in such behavior without refund.
• Photography and Filming: Guests may take photos for personal use only. Professional photography or filming is not allowed without prior authorization from Dreamwalk Park management.

3. Liability, Assumption of Risk, Release, and Waiver

• Assumption of Risk: Guests acknowledge that certain attractions may involve physical activity, awareness of surroundings, supervision of minors, or inherent risks. The nature of Dreamwalk Park’s immersive entertainment purpose includes irregular pathways, varying levels of visibility, blinking lights, irregularly textured walls, fog/mist, varying levels of noise, non-accessible areas, and other atypical navigational or sensory features. By entering the Park, guests assume all risks associated with participation.
• Limitations of Liability: Dreamwalk Park and its affiliates are not responsible for:
  • Injuries, losses, or damages sustained within the Park, except in cases of negligence by Dreamwalk Park.
  • Lost, stolen, or damaged personal property.
• Medical Emergencies: Guests with health conditions should consult their physician before participating in certain attractions. Guests with limited mobility, limited vision, limited hearing, sensory sensitivity, or other sensory limitations are welcome at the Park but should consult their physician before attending and should consider attending adaptive sessions where offered. In case of an emergency, Dreamwalk Park staff may attempt to provide first aid and coordinate with local emergency services as needed.

Release In the event that you, a guest of yours, or any other individual brings any claim, lawsuit, or action on behalf of you, your guests, or your guests’ estates, in violation of the assumption of risk, release, and waiver provisions outlined herein, you agree to indemnify, defend, and hold harmless Dreamwalk, its owners, affiliates, officers, employees, agents, and assigns against any and all such claims, actions, liabilities, or damages, including but not limited to legal fees, court costs, and any other expenses incurred in connection with the defense of such claims.

These risks are an inherent and unavoidable aspect of the Services. By engaging in or participating in any way with the Services, you (ON BEHALF OF YOURSELF AND YOUR GUESTS) knowingly and voluntarily assume all risks, including but not limited to risks of injury, death, or property damage, that may arise from such participation. In consideration of Dreamwalk granting you access to and permitting your participation in the Services, you (ON BEHALF OF YOURSELF AND YOUR GUESTS) hereby fully and irrevocably release, discharge, and hold harmless Dreamwalk, its owners, affiliates, officers, employees, agents, and assigns from any and all claims, liabilities, actions, or causes of action, including those arising from negligence, premises liability, or any injuries (including death) or damages of any kind, whether foreseeable or unforeseeable, that may result from or are in any way connected to your participation in or interaction with the Services. You further waive any right to bring any legal or equitable claim, suit, or proceeding against Dreamwalk, its owners, affiliates, officers, employees, agents, or assigns relating to the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL THE TOTAL LIABILITY OF DREAMWALK, INCLUDING ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS, TO ANY PARTY (REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU TO DREAMWALK FOR THE SPECIFIC CONTENT, PRODUCT, OR SERVICE IN THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRIOR TO THE EVENT GIVING RISE TO SUCH LIABILITY.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, THE DISCLAIMERS SET FORTH HEREIN SHALL NOT APPLY TO PRODUCT LIABILITY CLAIMS, STATUTORY CONSUMER RIGHTS, OR DAMAGES ARISING FROM DREAMWALK’S WILLFUL MISCONDUCT, RECKLESSNESS, FRAUD, OR GROSS NEGLIGENCE.

4. Indemnification

You agree to indemnify, defend, and hold harmless Dreamwalk, its parent company, affiliates, subsidiaries, and each of their respective partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any and all claims, demands, or actions, including reasonable attorneys’ fees, arising from or relating to any third-party claim resulting from: (i) your breach or alleged breach of these Terms; (ii) any Submissions made by you; (iii) your misuse or unauthorized use of the Services and/or Content; (iv) your violation of any applicable laws, regulations, codes, statutes, or orders issued by any governmental or regulatory authorities; (v) your infringement or violation of the rights of any third party, including, but not limited to, intellectual property, publicity, confidentiality, property, or privacy rights; (vi) your use of any third-party product, service, or website; or (vii) any false or misleading representation made by you. Dreamwalk reserves the right to assume, at your sole expense, the exclusive defense and control of any matter subject to indemnification hereunder. You agree to fully cooperate in the defense of any such claim. Under no circumstances will you settle any claim without the prior written consent of Dreamwalk.

5. Personal Data and Privacy

• Data Collection: Dreamwalk Park collects certain personal information as described in our Privacy Policy, including but not limited to contact information, ticket purchase data, and interactions within the Park.
• Usage: By entering the Park, guests consent to the collection and use of personal data as outlined in our Privacy Policy.
• Data Security: Dreamwalk Park uses reasonable security measures to protect guests’ personal information. However, we cannot guarantee complete data security.

6. Intellectual Property

• Trademarks and Copyrights: All content within Dreamwalk Park, including logos, artwork, designs, and characters, are the property of Dreamwalk Park and its licensors. Unauthorized use is strictly prohibited.
• Visitor Content: Guests grant Dreamwalk Park a non-exclusive, royalty-free license to use photos, videos, or other content created at the Park or by the Park for marketing purposes.

7. Changes to Terms and Conditions

Dreamwalk Park reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on our website and may also be made available at the Park.
